Terms of Use

These terms are an agreement between you and Train With Apex LLC governing access to Apex Health.

Acceptance and eligibility

By creating an account or using Apex, you accept these terms and the Privacy Policy. You must be at least 18 years old and legally able to enter this agreement.

Accounts

Provide accurate information, protect your credentials, and promptly report suspected unauthorized access. You are responsible for activity through your account.

Fitness, nutrition, and wellness

Exercise involves risk. Choose appropriate exercises, loads, form, equipment, surroundings, and supervision. Stop and seek qualified help for pain, injury, dizziness, faintness, concerning symptoms, or an emergency. Food and nutrition values may be incomplete, inaccurate, or outdated; product packaging is authoritative where values differ.

Pex AI

Pex uses artificial intelligence, powered in part by OpenAI, and may produce incomplete, inaccurate, outdated, or inappropriate output. Pex is not a physician, dietitian, therapist, trainer, or emergency service. You remain responsible for evaluating recommendations. Review the AI Disclosure.

Acceptable use

Do not misuse Apex, interfere with security or availability, attempt unauthorized access, introduce malicious code, scrape protected systems, impersonate another person, submit unlawful or harmful content, exploit automated features, or violate law or another person's rights.

User content and feedback

You retain ownership of content you enter. You grant Train With Apex LLC a limited right to host, process, reproduce, and display it only as needed to operate, secure, support, and improve Apex. You may submit feedback, which Apex may use without an obligation to compensate you.

Subscriptions

Apex may offer automatically renewing subscriptions. In-app digital subscriptions are billed by Apple or Google under the price, duration, renewal, cancellation, and refund terms shown before purchase and in your marketplace account. Deleting Apex does not cancel a subscription. Manage or cancel through Apple App Store or Google Play settings. Web purchases, if offered, may be processed by Stripe.

Third-party services and FatSecret

Apex relies on third-party services including Supabase, OpenAI, FatSecret, PostHog, Cloudflare, Fly.io, Apple, Google, and Stripe where applicable. Those services may have separate terms. By using features displaying FatSecret content, you agree to the FatSecret Platform API Terms of Use. FatSecret does not endorse Apex.

Intellectual property

Apex Health, Pex, the software, design, branding, and service content—excluding user and third-party content—belong to Train With Apex LLC or its licensors. You receive a limited, personal, revocable, non-transferable right to use the service.

Suspension and termination

You may stop using Apex or delete your account. We may restrict or terminate access for a material breach, abuse, legal requirement, or security risk. See Account Deletion.

Availability, warranties, and liability

Apex may change and may experience errors or interruptions. To the extent permitted by law, Apex is provided “as is” without a guarantee of uninterrupted, secure, or error-free operation. To the extent permitted by law, Train With Apex LLC is not liable for indirect or consequential loss. Nothing limits a consumer right or liability that cannot legally be limited.

Legal review required

No governing-law, venue, mandatory-arbitration, or class-action-waiver term is stated. Train With Apex LLC should obtain legal advice before adding one.
